David Cumin retrace, dans ce livre, toute l'évolution politique et intellectuelle du publiciste allemand, spécialiste de droit international, mais aussi politologue, philosophe, historien et théologien du IIe Reich jusqu'à la République de Bonn, en passant par la République de Weimar et le IIIe Reich. Juriste universitaire engagé dans une entreprise de refondation antinormativiste de la science du droit, Carl Schmitt est fondamentalement (après 1918) l'adversaire du parlementarisme, du pluralisme et du fédéralisme weimariens, et l'avocat du « système présidentiel » en tant que gouvernement plébiscitaire, autoritaire et unitaire s'appuyant sur l'armée, la fonction publique et le fameux article 48 de la constitution du Reich. Au plan idéologique, ce nationaliste catholique est à la fois un proche du fascisme italien (dès 1923), une figure de la « révolution conservatrice » allemande (après 1928), un collaborateur du national-socialisme (après 1933). La problématique nodale de cette biographie, dans un contexte historique catastrophique, est de montrer comment un néoconservateur antilibéral et antimarxiste, devenu un conseiller du gouvernement présidentiel, cultivant un raisonnement ambigu de « défense de la constitution » et dénonçant la « révolution légale » (avant de s'y rallier), passe de Schleicher à Hitler, de la « dictature commissariale » au « totaler Staat » puis au « Führerstaat » s'engage dans une certaine version du national-socialisme acquiert et conserve une place de premier rang dans la doctrine allemande enfin présente son plaidoyer à et après Nuremberg.

In this book, David Cumin reviews the entire political and intellectual evolution of Carl Schmitt - the German specialist of public and international law, political analyst, philosopher, historian and theologian - covering the period from the 2nd Reich to the Bonn Republic, so taking in the Weimar Republic and the Third Reich. An academic jurist committed to re-founding the science of law on an anti-normative basis, Carl Schmitt was (after 1918) a fundamental adversary of the parliamentary system, pluralism and Weimarian federalism. He advocated the ‘presidential system' as a form of plebiscitary - an authoritarian and unitary government based on the army, the civil service and the Reich constitution's famous article 48. On the ideological side, this Catholic nationalist was already close to Italian Fascism as early as 1923, a notable figure of Germany's ‘conservative revolution' after 1928, and, by 1933, one of National Socialism's collaborators. The central problematic of this biography is to show how an anti-liberal and anti-Marxist neo-conservative, advisor to the presidential government, who cultivated an ambiguous concept of the ‘defence of the constitution' and denounced the ‘legal revolution' before joining its ranks - evolved from Schleicher to Hitler, from the ‘commissarial dictatorship' to the ‘total Staat' then the ‘Fuhrerstaat', in a historical context plagued with catastrophe and how he became engaged in a certain version of National Socialism, acquired and kept a top position in Germany, and ultimately, how he presented his own justification at and after Nuremberg.
